Algemene Voorwaarden Gunther Frans Photography (GFP)
§ 1. Algemeen
Deze bepalingen regelen de persoonlijke deelname aan workshops, coaching, en evenementen georganiseerd door Gunther Frans Photography (GFP).
§ 2. Deelname
De deelname aan activiteiten van GFP, inclusief heen- en terugreis, geschiedt op eigen kosten. Deelnemers dienen tijdig aanwezig te zijn op de locatie om de aanvangstijd te respecteren. Gedurende de activiteit dienen deelnemers de instructies van GFP of diens medewerkers op te volgen.
§ 3. Inschrijving/Annulatie
Inschrijving en betaling vindt plaats via het online formulier op de GFP-website. Annulering is mogelijk volgens de volgende voorwaarden:
Annulering minstens 14 dagen voor het evenement: Geen volledige terugbetaling, maar het betaalde bedrag wordt omgezet in een tegoed voor een volgend evenement.
Annulering binnen 7 dagen voor het evenement: 50% van het betaalde bedrag wordt omgezet in een tegoed voor een volgend evenement.
Annulering binnen 12 uur voor het evenement: Geen terugbetaling en geen tegoed beschikbaar voor een volgend evenement.
§ 4. Gebruiksrechten
Deelnemende modellen hebben het onherroepelijke recht om de door GFP vrijwillig ter beschikking gestelde digitale beelden onbeperkt in tijd te gebruiken voor persoonlijke doeleinden, zoals sociale media, websites, en portfolio's. Bij het tonen van andere deelnemers op foto's is het essentieel ervoor te zorgen dat deze foto's niet zonder toestemming openbaar worden gemaakt of verspreid. Het gebruik van foto's is beperkt tot niet-commerciële doeleinden en mag niet worden ingezet voor promotie of verkoop.
§ 5. Foto's en Video's
GFP behoudt het recht om foto- of videomateriaal te maken tijdens activiteiten waarop deelnemers en/of modellen te zien zijn. Deelnemers geven expliciete toestemming voor het gebruik van dit materiaal voor documentatie of reclamedoeleinden op het internet of andere media. Deze toestemming is onherroepelijk en geldt voor onbepaalde tijd, met de voorwaarde dat de afgebeelde persoon niet in diskrediet kan worden gebracht door de openbaarmaking.
§ 6. Aansprakelijkheid
GFP kan niet aansprakelijk worden gesteld voor schade aan deelnemers tijdens heen- en terugreis of voor beschadigde of verloren voorwerpen tijdens de activiteit. GFP is alleen aansprakelijk voor materiële schade bij opzet of nalatigheid van GFP of diens medewerkers.
§ 7. Waarschuwing/Uitsluiting
De instructies of aanwijzingen van GFP of diens medewerkers dienen te allen tijde worden opgevolgd. Bij niet-naleving kan een waarschuwing volgen, gevolgd door uitsluiting bij herhaalde inbreuken.
GFP behoudt zich het recht voor om deelnemers met aanhoudende of grove overtredingen zonder waarschuwing uit te sluiten van het vervolg van de workshop, event of coaching.
Uitgesloten deelnemers blijven gehouden tot betaling van de volledig verschuldigde deelnameprijs. Uitsluiting geeft geen recht op enige terugbetaling van deelnameprijs.
§ 8. Annulatie van de Workshop, Event of Coaching
Bij annulatie door GFP (wegens ziekte of onderbezetting) wordt het reeds betaalde deel van de deelnameprijs onmiddellijk terugbetaald. Deelnemers kunnen geen aanspraak maken op enige andere vergoeding.
§ 9. Afsluitende Bepalingen
Afwijkende voorwaarden maken geen deel uit van de overeenkomst, tenzij schriftelijk overeengekomen met GFP.
Bij ongeldigheid van een van de hogergenoemde voorwaarden blijven andere bepalingen van kracht. De partijen verbinden zich ertoe in dat geval vervangende voorzieningen te treffen.
Bevoegdheid voor alle geschillen behoort toe aan de rechtbanken in het Arrondissement Leuven.

§ 1. Généralités
Les présentes dispositions régissent la participation personnelle aux ateliers, aux séances de coaching et aux événements organisés par Gunther Frans Photography (GFP).
§ 2. Participation
La participation aux activités de GFP, y compris les frais de déplacement, est à la charge du participant. Les participants doivent être présents à l'heure sur le lieu afin de respecter l'heure de début. Pendant l'activité, les participants doivent suivre les instructions de GFP ou de ses collaborateurs.
§ 3. Inscription/Annulation
L'inscription se fait via le formulaire en ligne sur le site web de GFP. L'annulation est possible selon les conditions suivantes :
Annulation au moins 14 jours avant l'événement : Aucun remboursement complet, mais le montant payé est converti en crédit pour un prochain événement.
Annulation dans les 7 jours précédant l'événement : 50 % du montant payé est converti en crédit pour un prochain événement.
Annulation dans les 12 heures précédant l'événement : Aucun remboursement et aucun crédit disponible pour un prochain événement.
§ 4. Droits d'utilisation des images
Les modèles participants ont le droit irrévocable d'utiliser les images numériques mises à disposition par GFP à des fins personnelles (médias sociaux, site web, portfolio) sans limite de temps. Lorsque d'autres participants sont visibles sur les photos, il est essentiel de veiller à ce que celles-ci ne soient pas rendues publiques ou diffusées sans leur consentement. L'utilisation des photos est limitée à des fins non commerciales et ne peut pas être utilisée à des fins promotionnelles ou de vente.
§ 5. Photos et Vidéos
GFP se réserve le droit de prendre des photos ou des vidéos pendant les activités où les participants et/ou les modèles sont visibles. Les participants donnent leur consentement explicite à l'utilisation de ce matériel à des fins de documentation ou de publicité sur Internet ou tout autre média. Ce consentement est irrévocable et valable indéfiniment, à condition que la personne représentée ne puisse être discréditée par sa diffusion.
§ 6. Responsabilité
GFP ne peut être tenu responsable des dommages subis par les participants pendant le trajet ou des objets endommagés ou perdus pendant l'activité. GFP n'est responsable des dommages matériels que en cas de faute intentionnelle ou de négligence de GFP ou de ses collaborateurs.
§ 7. Avertissement/Exclusion
Les instructions ou les indications de GFP ou de ses collaborateurs doivent toujours être suivies. En cas de non-respect, un avertissement peut être émis, suivi d'une exclusion en cas d'infractions répétées.
GFP se réserve le droit d'exclure les participants en cas d'infractions persistantes ou graves sans avertissement préalable.
Les participants exclus restent tenus au paiement intégral des frais de participation dus. L'exclusion ne donne droit à aucun remboursement des frais de participation.
§ 8. Annulation de l'atelier, de l'événement ou du coaching
En cas d'annulation par GFP (en raison de maladie ou de sous-effectif), les participants recevront immédiatement le remboursement de la partie déjà payée des frais de participation. Les participants ne peuvent prétendre à aucune autre indemnisation.
§ 9. Dispositions finales
Les conditions dérogatoires ne font pas partie de l'accord, sauf accord écrit avec GFP.
En cas d'invalidité d'une des conditions susmentionnées, les autres dispositions restent en vigueur. Les parties s'engagent alors à prendre des dispositions de remplacement.
La compétence pour tous les litiges découlant de la relation contractuelle appartient aux tribunaux de l'Arrondissement de Louvain.

General Terms and Conditions of Gunther Frans Photography (GFP)
§ 1. General
These provisions govern personal participation in workshops, coaching sessions, and events organized by Gunther Frans Photography (GFP).
§ 2. Participation
Participation in GFP activities, including round-trip travel, is at the participant's own expense. Participants must be present on time at the location to respect the starting time. Throughout the activity, participants are required to follow the instructions of GFP or its staff.
§ 3. Registration/Cancellation
Registration and payment is done through the online form on the GFP website. Cancellation is possible under the following conditions:
Cancellation at least 14 days before the event: No full refund, but the paid amount is converted into credit for a future event.
Cancellation within 7 days before the event: 50% of the paid amount is converted into credit for a future event.
Cancellation within 12 hours before the event: No refund, and no credit available for a future event.
§ 4. Usage Rights of Images
Participating models have the irrevocable right to use the digital images voluntarily provided by GFP for personal purposes (social media, website, portfolio) without any time restrictions. When other participants are visible in photos, it is essential to ensure that these photos are not made public or distributed without their consent. The use of photos is limited to non-commercial purposes and cannot be used for promotional or sales purposes.
§ 5. Photos and Videos
GFP reserves the right to take photos or videos during activities where participants and/or models are visible. Participants explicitly consent to the use of this material for documentation or advertising on the internet or any other media. This consent is irrevocable and valid indefinitely, with the condition that the depicted person cannot be discredited by its disclosure.
§ 6. Liability
GFP cannot be held liable for damages suffered by participants during travel or for damaged or lost items during the activity. GFP is only liable for material damage if caused intentionally or through negligence of GFP or its staff.
§ 7. Warning/Exclusion
Instructions or guidance from GFP or its staff must be followed at all times. Non-compliance may result in a warning, followed by exclusion in the case of repeated infractions.
GFP reserves the right to exclude participants with persistent or serious violations without prior warning.
Excluded participants remain obligated to pay the full participation fee. Exclusion does not entitle any refund of the participation fee.
§ 8. Cancellation of the Workshop, Event, or Coaching
In the event of cancellation by GFP (due to illness or understaffing), participants will immediately receive a refund of the already paid portion of the participation fee. Participants cannot claim any other compensation.
§ 9. Concluding Provisions
Deviating conditions do not form part of the agreement unless explicitly and in writing agreed upon with GFP.
In the event of invalidity of any of the above conditions, the validity of the other provisions is not affected. In such cases, the parties undertake to make substitute arrangements.
Jurisdiction for all disputes arising from the contractual relationship belongs to the courts in the District of Leuven.
